WHAT IS IT?

A “Music Use License”  is permission from the owner of a master recording to use their recording on your own CD, or in your own project.  An example of this is when a singer records their voice over a “karaoke track”, puts the recording on a CD and duplicates the CD for distribution or sale.

WHY DO I NEED ONE? 

Someone else paid to have the karaoke recording made and they own the copyright to the recording.  Even though you may have paid for a copy of the recording to sing with, under United States Copyright Law you cannot reproduce, for sale or distribution, other people’s copyrighted works without first obtaining permission from the copyright owner.  

Our CDs and downloads are used by amateur and professional entertainers all over the world. Once our music has been purchased, our customer has our permission to use their purchased recordings for personal in home use, as accompaniment music for entertaining and performing for profit or nonprofit, in public venues or private, and for use as an aid in music and vocal instruction. However, a fee must be paid for the use of our music in a product being reproduced for distribution or resale.  Please note that this permission is only for the use of our particular rendition / master recording of the song.  There may be other licenses required from the original author / copyright owner for your particular use of the song. 

HOW MUCH DOES IT COST?

If you are making CDs, DVDs, or some other mechanical reproduction of our recording(s), the following table applies.  The prices are per song / per CD (or DVD, etc) reproduced, and are for projects by individual artists for non-commercial use (i.e. not for use in movies, TV shows, etc). 

If you are using a master recording from a source other than ProSound Music, you must contact that source for a Use License before reproducing your product.

WHAT DOES THE LICENSE AGREEMENT SAY?

In general terms, this agreement says that ProSound Music owns all the rights to its recordings and is giving you permission to use certain of those recordings in your project.  The particular recordings you may use, the approved uses of the recordings, length of the agreement and territory where you may use the recordings is specified. 

The “Warranties” section says that other entities (such as the original author and publishers) may own copyrights to the songs, for which you must obtain separate licenses, in addition to this use license for the use of our recording.  It also says that this agreement does not give you any ownership of our recording, so you can’t sell it to other people, except as authorized in the agreement. 

Specific permission is given for the approved use of the recordings.  Fees for the use of the recordings are specified.

ProSound Music is given permission to check your records if we feel you are not properly reporting sales and distribution of your product to us. 

You are told where to send correspondence.  Other miscellaneous items say that each individual part of the agreement stands on its own and is not necessarily affected by any other part, we are not partners and you are not our employee, you may not assign this agreement to anyone else.  Approved notice or correspondence is outlined, as well as termination rules.  It states that the laws of Utah apply to the agreement, it is the entire agreement, the agreement is only for your benefit and our benefit – no one else, etc.
